THE BRIDEFOLIO TERMS AND CONDITIONS

Welcome to The Bridefolio! The Bridefolio features various wedding gowns and clothing items (collectively, the “Wedding Items”) in its website, social media or email accounts, or in any of its platforms (collectively, the “Platform”), which you may choose to purchase or rent. However, before you proceed, please read these Terms and Conditions (the “Terms”) carefully.

The services offered by The Bridefolio are made available to you pursuant to these Terms. By accessing or using the Platform, or availing of the services of The Bridefolio, you agree to comply with, and be bound by, these Terms, without limitation or qualification. If you do not agree to these Terms, please do not access or use the Platform, or avail of the services of The Bridefolio.

You may not accept these Terms if you are under 18 years of age. We reserve the right to only provide our services to those over 18 years of age.

We may amend these Terms at any time by posting the changes in this page. It is your responsibility to check this page for the most updated version of these Terms. If you do not agree to any change to these Terms, then please immediately stop using the Platform or availing of the service of The Bridefolio. Your continued use of the services offered by The Bridefolio after the posting of any changes to these Terms shall constitute your acceptance of those changes. However, any changes made after you have confirmed your booking shall not affect that booking.

KEY TERMS

Wherever the context so requires “you” or “your” or “Client” shall mean any natural person who accesses or uses the Platform, or avails of the services of The Bridefolio, and “we” or “us” shall mean The Bridefolio.

PRIVACY NOTICE

By accessing or using the Platform, or availing of the services offered by The Bridefolio, The Bridefolio may collect, use, disclose, store, and dispose of your personal information. For more information on how The Bridefolio uses or handles your personal information, you may read its Privacy Notice (as updated from time to time) found in the Platform.

SELECTION OF WEDDING ITEM

You may select Wedding Item options from any Platform of The Bridefolio. Upon selecting the Wedding Items you like, you may either contact us directly through our social media or email accounts, or by filling up the Appointment Form on the website. The Bridefolio will have discretion on when to release prices, usually but not limited to after you share your options to us.

We will coordinate with you, either through social media or email, regarding the next steps which are, but not limited to, virtual viewing, home fittings, alterations, and consultations. The Bridefolio has discretion on which steps will be necessary, depending on your need.

VIRTUAL VIEWINGS AND HOME FITTINGS

Virtual viewings are done via Zoomon a schedule agreed upon between The Bridefolio and the Client.

Home fittings shall be charged a non-deductible Php5,000.00, which shall include the delivery of the Wedding Items to the Client’s house, and a Zoom call with one of the stylist consultants of The Bridefolio. The car delivery service will be at the Client’s house for a maximum of one (1) hour, at which point the Client should return the Wedding Items to The Bridefolio through the car service.

PAYMENT TERMS

Prices quoted are as of at the time of each quote and may be subject to change at any time.

The Client shall be required to pay a non-refundable downpayment upon confirmation of the Wedding Item and signing of the Agreement. The Client shall be required to pay the purchase price or rental price in full before the selected Wedding Item is released. Should the Wedding Item exceed the cost of Php100,000.00, a security deposit in an amount to be determined by The Bridefolio depending on the Wedding Item will be required.

The Client can choose to pay for the selected Wedding Item using any of the different payment methods offered below:

1.     Bank transfer using the bank details provided by The Bridefolio

2.     Online transfer

The Bridefolio reserves the right to offer additional payment methods and/or remove existing payment methods at any time in its sole discretion.

DELIVERY

The Client may opt to pick up the Wedding Item at an agreed location with The Bridefolio, or to receive the Wedding Item via courier. The Bridefolio will shoulder delivery costs within Metro Manila, or refund the Client if initially paid for by the Client. The Client will shoulder delivery costs outside of Metro Manila.

The final delivery date will be agreed upon by both parties. Should the Client want the Wedding Item earlier than the agreed date, The Bridefolio will have sole discretion on determining if this will be possible.

Delays in delivery of a Wedding Item due to force majeure shall not entitle the Client to refuse to take delivery of the Wedding Item.

The Bridefolio shall not be liable for delivery issues due to incomplete, incorrect or missing information provided by the Client. Client is obliged to provide information that is complete, accurate and truthful for the proper processing of the order, including Client’s delivery address and contact information.

Without prejudice to any other clauses in these Terms, in cases where we attempt to deliver a Wedding Item, but we are unable to do so due to the reasons caused by the Client, we will contact the Client via, among others, call or message, or email, to inform the unsuccessful delivery and next steps. In such cases, The Bridefolio reserves the right to cancel the booking without refund or remedy to the Client. If the Client remains uncontactable or fails to receive the Wedding Item within thirty (30) minutes from the time the Wedding Item arrives at the Client’s delivery address, The Bridefolio reserves the right to cancel the booking without refund or remedy to the Client.

TITLE, RISK OF LOSS OR DAMAGE

For home fittings, risk of loss or damage to the Wedding Item shall pass on to the Client upon turnover to, acceptance of, the Wedding Item during home fittings. In case of loss of, or irreparable damage to, the Wedding Item, the Client shall pay the full purchase price of the lost or damaged Wedding Item.

Title to the Wedding Item purchased shall not pass to you until The Bridefolio receives payment in full (in cash or cleared funds) for such Wedding Item.

The risk of loss or damage to the Wedding Item, whether purchased or rented, will pass to you upon delivery of the Wedding Item. For Wedding Items rented, the risk of loss or damage shall not revert back to The Bridefolio until it has actually been received by The Bridefolio.

The Client shall be liable for any damage to the Wedding Item rented. In case of loss of, or any irreparable damage to, the Wedding Item rented, the Client shall pay the full purchase price of the lost or damaged Wedding Item.

WARRANTIES

The Bridefolio has made every reasonable effort to display in the Platform or its social media accounts as accurately as possible the Wedding Items as they physically appear. The Bridefolio cannot guarantee that the appearance of the Wedding Item as seen in your computer or device will be accurate.

The Bridefolio does not warrant or represent that the Platform will be uninterrupted, error-free, free of technical difficulties, defects, viruses or other harmful components and we accept no liability for them. Please expect temporary interruptions of the Platform due to scheduled or regular system maintenance work, downtimes attributable to internet or electronic communications or events of force majeure. 

RETURN

The Wedding Item rented shall be returned unwashed by the Client within three (3) days from the time it was delivered or picked-up. The Client shall not wash or alter the Wedding Item prior to its return. The Client may opt to drop off the Wedding Item at an agreed location with The Bridefolio, or to send the Wedding Item via courier. The Bridefolio will shoulder delivery costs within Metro Manila, or refund the Client if initially paid for by the Client. The Client will shoulder delivery costs outside of Metro Manila.

For each day that the Wedding Item is still with the Client after the agreed return date, the Client will be charged P5,000.00. If the Wedding Item is still with the Client more than seven (7) days after the agreed return date, the Client will be charged the full purchase price of the Wedding Item.

Any claim by Client (i) that any Wedding Item purchased or rented do not conform to the specifications, or (ii) made otherwise with respect to the Wedding Item, whether based on breach of warranty, contract, negligence, strict liability, or other tort, must be made by the Client prior to pick up or within 1 hour from the time of delivery, as the case may be, and will be deemed to be waived once the Wedding Item has been picked up or delivered without any claim from the Client within the said period.

Client’s exclusive remedy and The Bridefolio’s exclusive liability for delivery of nonconforming Wedding Items or for breach of any warranty is expressly limited to refund of the purchase price or rental price to the extent already paid.  All non-conforming Wedding Items must be returned to us in the manner specified.

INDEMNIFICATION

Client agrees to indemnify and hold harmless The Bridefolio, its employees, officers, agents, contractors, service providers from any and all claims, losses, and damages (including attorney’s fees) to the extent arising out of (i) Client’s negligence or wilful misconduct, (ii) any breach of these Terms by the Client, or (ii) loss of, damage to, the Wedding Item after delivery. 

LIMITATION OF LIABILITY

Notwithstanding anything to the contrary herein:

1.     in no event shall The Bridefolio be liable to the Client or any third party for any indirect, consequential, incidental, special, punitive or exemplary damages, of whatsoever nature, whether arising out of breach of contract, warranty, tort, contribution, indemnity, subrogation or otherwise;

2.     in no event shall The Bridefolio be liable to the Client or third parties for damages caused by the acts or omissions of the Client; and

3.     in no event shall The Bridefolio’s liability to the Client exceed the amount received by The Bridefolio from the Client under the applicable booking.

SEVERABILITY
In the event that any provision of these Terms are determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms, such determination shall not affect the validity and enforceability of any other remaining provisions.

FORCE MAJEURE

With the exception of payments, neither party will be liable for its failure to perform any of its obligations during any period to the extent that such party cannot perform due to events beyond such party’s reasonable control, including but not limited to: acts of God; earthquake; terrorism; war; riots; insurrections; laws; proclamations; catastrophe; sabotage; regulations; strikes; floods; fires; explosions; equipment failure; labor strike or work stoppage; acts of any government body; disease; shortage or non-availability of transportation . 

WAIVER
Any failure of Seller to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

ENTIRE AGREEMENT

These Terms and any policies or rules issued by The Bridefolio in respect to the Wedding Items, and the confirmation of your booking, including the terms therein, constitutes the entire agreement and understanding between The Bridefolio and Client and govern any purchase or rent of the Wedding Items by the Client, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between The Bridefolio and the Client (including, but not limited to, any prior versions of the terms and conditions). Any ambiguities in the interpretation of these Terms shall not be construed against the drafting party.

INTELLECTUAL PROPERTY

Without the express written consent of The Bridefolio, the Client will not use The Bridefolio’s trade names, trademarks, logos, service marks, or other proprietary marks for any purpose.

THIRD PARTY LINKS AND WEBSITES

The Platform may contain links to other third-party products, websites, services and offers and by clicking on these third-party links, Client agree to do so at Client’s own risk. These third-party links, products, websites and services not owned or controlled by us. We do not control or endorse these third-party websites or links and shall not be responsible for the content, functionality, security, services, privacy policies, or other practices of these third party linked pages. We accept no liability or responsibility for any loss or damage which may be suffered by Client in relation to Client’s access and use of these third party links and websites.

GOVERNING LAW AND DISPUTE RESOLUTION

These Terms shall be governed by and construed in English in accordance with the laws of the Philippines. Any dispute arising from these Terms shall subject to the jurisdiction of the appropriate courts of Muntinlupa City, to the exclusion of all other courts in the Philippines.
